INTRODUCTION

The Stackla Organic Advocates Platform is owned and operated by Stackla on behalf of our clients. The Platform was created to allow Brands and Advocates to interact, form relationships, and for Brands to request for Advocates to create content based upon Creative Briefs.

Each Advocate’s access to use the Stackla Organic Advocates Platform is conditional upon their agreement to and acceptance of these Terms and Conditions. Each time an Advocate uses the Stackla Organic Advocates Platform they agree to be bound by these Terms and Conditions. If an Advocate does not wish to be bound by these Terms and Conditions, they shouild not use the Stackla Organic Advocates Platform.

Stackla at anytime may revises these Terms and Conditions by updating this page. Revisions will take immediate effect and may impact your ability to use the Stackla Organic Advocates Platform. As each Advocate is bound by the Terms of Use each time they use the Stackla Organic Advocates Platform, they are encouraged to check these Terms of Use for any revisions each time they use the Stackla Organic Advocates Platform and whenever they are prompted to do so. These Terms and Conditions are in addition to any Terms and Conditions a brand may apply for use of their respective Stackla Organic Advocates Platform instance.

An Advocate’s use of the Stackla Organic Advocates Platform after any revision to the Terms and Conditions constitutes their acceptance of those revisions.

Stackla reserves the right to change the Stackla Organic Advocates Platform in anyway and will give appropriate notice to Advocates when the changes affect their ability to use the Platform.

An Advocates ability to access the Stackla Organic Advocates Platform maybe terminated at any time without notice by Stackla or the Brand upon which you have registered with.

Any cost associated with using the Stackla Organic Advocates Platform remain the responsibility of the Advocate.

USING THE STACKLA ORGANIC ADVOCATES PLATFORM

The Stackla Organic Advocates allows for Brands to interact with Advocates and to request the creation of content for respective Creative Briefs.

Content created / provided by the respective Brand or Advocate, as applicable, is not moderated, approved or endorsed by Stackla. Accordingly, no Content constitutes a representation by Stackla, nor does Stackla accept any liability for the legality, validity, accuracy or suitability of any content provided by Advocates or Brands.

Incentives relating to Creative Briefs offered through the Stackla Organic Advocates Platform are based upon the Terms and Conditions defined by the brand, and will be facilitated by the respective brand based upon the respective conditions they have defined. Stackla does not accept any liability for any brand’s fulfilment of any respective incentives, nor enforcement of the brand’s respective Terms and Conditions.

All Advocates and Brands using the Stackla Organic Advocates Platform agree not to:

circumvent the Stackla Organic Advocates Platform;

decompile, reverse engineer, disassemble, convert or authorize any third party to decompile, reverse engineer, disassemble or otherwise convert any element of the Stackla Organic Advocates Platform to a human perceivable form;

distribute or republish any element of the Stackla Organic Advocates Platform in any way;

resell, rent, lease, licence or lend any element of the Stackla Organic Advocates Platform;

defeat, disable or circumvent any security feature of the Stackla Organic Advocates Platform;

transfer any element of the Stackla Organic Advocates Platform to any third party;

use any data mining, robots or similar data gather or extraction methods;

register, subscribe or unsubscribe, or attempt to subscribe or unsubscribe, any party to any product or service if you are not expressly authorised by such party to do so; or

sell, licence, lease or in any way seek to commercialise any component of the Stackla Organic Advocates Platform without specific written authorisation from Stackla.

The Stackla Organic Advocates Platform is designed for use by people aged 16 years and over. Users under the age of 16 years may only use the Stackla Organic Advocates Platform with the consent of a parent or legal guardian.

Advocates are solely responsible for your interactions with other users of the Stackla Organic Advocates Platform.

Advocates and Brands agree that Stackla is not responsible for the conduct of any user.

Advocates must not engage in crawling, scraping, caching or otherwise accessing any content on the Stackla Organic Advocates Platform via automated means, except with Stackla’s written consent.

Nothing in these Terms and Conditions is intended nor does create a partnership, agency, employment or fiduciary relationship between Stackla and any Advocate.

Advocates, subject to their compliance with these Terms and Conditions are granted a limited, non-exclusive, revocable and non-transferrable licence to access and use the Stackla Organic Advocates Platform in the manner anticipated in these Terms of Use.

Any costs associated with accessing and using the Stackla Organic Advocates Platform remains the responsibility of the respective Advocate.

REGISTERING AN ACCOUNT

In order to use the Stackla Organic Advocates Platform, Advocates must register an account via the Application in the manner required and as set out in these Terms and Conditions.

Stackla reserves the right to refuse or cancel registration of an Account for any reason in its sole discretion. Any decision of Stackla is final and no correspondence will be entered into.

All information provided when registering an Account must be current, correct and complete. Incomplete, ineligible or incomprehensible Account registrations will not be valid. You must be logged in to your Account in the manner required each time you wish to use the Stackla Organic Advocates Platform. Advocates may never use another’s Advocates Account without their permission.

Advocates are responsible for maintaining the strict confidentiality of their Account details and for any activity under their Account. Advocates agree to immediately notify Stackla or the respective Brand of any unauthorised use of their Account or any other breach of security. It is the Advocate’s sole responsibility to control access to and use of your Account and to notify Stackla when they desire to cancel their Account. Stackla will not be responsible or liable for any loss or damage arising from an Advocate’s failure to comply with this provision.

Stackla retains the right and absolute discretion to terminate an Advocates Account and/or access to the Stackla Organic Advocates Platform (or any element thereof) if it believes that an Advocate is abusing or tampering with the Stackla Organic Advocates Platform (or any element thereof) in any way, that they have breached these Terms and Conditions, or that thee Advocate has engaged in any unlawful, unethical, unsportsmanlike or other misconduct calculated to jeopardise the proper administration of the Stackla Organic Advocates Platform (or any element thereof). Stackla’s legal rights to recover damages or other compensation from such an offender are reserved.

The use of any automated software or any other mechanical or electronic means allowing an Advocate to create Accounts is prohibited. Stackla reserves the right to suspend or terminate an Advocate’s Account if it believes they are engaging in such activity.

Stackla Pty Ltd, Stackla Inc and Stackla Limited collects personal information about you from our websites as per our Privacy Policy. Personal information is generally collected in order to allow you to sign up or register to become a member of a Website, to submit content and participate in a Website, to engage with other users and respond to campaigns or briefs, to make or receive incentives, respond to inquiries, maintain our relationship with you, provide you with certain content, products and services and, unless you opt-out or unsubscribe, to contact you in the future with information on products and services.
